1- Introduction

We are committed to respecting the proprietary rights of others.

It is our policy to hold the user fully responsible and liable for their actions on the Site. It is our policy that our users are responsible for their actions on the Site, including for any liability that may arise as a result of such actions. We require our users to ensure their use of the Site at all times complies with all applicable laws, our Terms of Use, Privacy Policy and Username Policy. Our informal rules and guidelines also remind our users not to use the Site in such a way that may infringe the rights of other persons.

2- Definitions

The following words and expressions have the following meanings unless inconsistent with the context:

3- Our Policy

In fairness to our users, as well as to rights holders, our policy is to respond to notices of alleged infringement within 24 hours of receipt. We take all such notices seriously, and will review each complaint for substance and investigate each reported incident. As part of our investigation, it may be necessary for us to contact the user in question to verify the complaint. Based on the results of our investigation, we will take the action(s) as we consider appropriate in the circumstances or as required by Canadian law. For example, if as a result of our investigation, it is determined that the complaint has merit, we may take steps to remove the content complained of and may, in appropriate circumstances, terminate user account(s) associated with a user who is the subject of repeated complaints.

4- Notification

If you are the owner, or a person authorized to act on behalf of the owner, of content that has been uploaded on the Site and object to such use, you may request that the content be removed. To make such a request, please email us, or send us a letter by registered mail, to the attention of the contact person and at the addresses noted above.

We kindly ask that you provide the following information in your request: (1) identify yourself as the owner, or a person authorized to act on behalf of the owner; (2) the content that is on the Site the use of which you object; (3) the basis for your objection.

5- Informal Request

Alternatively, you may make an informal request for removal to our community managers. If you choose this route, you can post a message on the Site explaining your concerns or contact an active community manager directly. A complete list of the community managers can be found here.

We only consider ourselves to be notified of an alleged infringement if we receive the notification by e-mail or by registered mail. If you choose to post a message on the Site or notify a user moderator or community manager we do not consider ourselves to be notified.

6- Counter-Notifications

We recognize that not every notice of alleged infringement has merit or is made in good faith. In such cases, we strongly encourage users to file counter-notifications when they believe a request to remove content is without merit or made in bad faith. If we have already removed or disabled access to the content, it will remain as such until a proper investigation of the counter-notification has been conducted.

7- Removal of Content

If following our investigation, we, in our sole discretion, consider the allegation of infringement to be of merit, we may in our sole discretion immediately remove the content in its entirely, or remove the offending portion, from the Site, without any notice or liability to the user who uploaded the content or any other person.

8- Actual Knowledge

We do not actively browse, moderate or participate on the Site; however, without limiting the generality of the foregoing, we do access the Site to respond to user questions and complaints, develop new features, bug fix and view user-generated content that has been brought to our attention by an automated or user-activated reporting feature.

If while accessing the Site we become aware of any content that in our view is being improperly used, without any notice or liability to the user who uploaded the content or any other person, we may take such action we consider appropriate in the circumstances, which may include, but is not limited to, immediately blocking access to such content or removing such content from the Site.

9- Amendments

We may, in our sole discretion, change, supplement, or amend this policy from time to time without any prior notice or liability to users or any other person.
